1. Who we are

These Terms & Conditions ("Terms") govern your use of the Eventovias website and the digital wedding stationery, invitation, save-the-date and RSVP services (collectively, the "Service") operated by AW, obrt za trgovinu i usluge (referred to as "we", "us" or "Eventovias"). By creating an account, purchasing a design, or otherwise using the Service you agree to be bound by these Terms.

2. The Service

Eventovias provides premium, customizable wedding invitation and save-the-date templates that you can edit in our online editor, publish at a unique shareable URL, and use to collect RSVPs from your guests.

3. Your account

You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

4. Acceptable use

You must not use the Service to:

• break any applicable law or regulation;
• commit fraud, send spam, or impersonate another person;
• infringe anyone's intellectual property or privacy rights;
• upload malicious code, probe, scan or otherwise interfere with the security of the Service; or
• scrape, copy or resell any part of the Service or its content.

5. Your content

You retain ownership of the text, photos, music links and other content you upload to your designs ("Your Content"). You grant us a limited, worldwide, non-exclusive licence to host, store, display and process Your Content solely for the purpose of providing the Service to you. You are responsible for ensuring you have the rights necessary to upload Your Content.

6. Our intellectual property

The Service, including the website, the editor, the template designs, the brand, logos and all related software and documentation, is owned by Eventovias and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the templates you have purchased for your personal wedding event. You may not resell, redistribute, sublicense or reverse engineer any part of the Service.

7. Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and refund mechanics are governed by the Paddle Buyer Terms, which apply in addition to these Terms.

Prices are shown in the relevant currency at checkout and are inclusive of any applicable taxes. Once payment is complete, your design becomes available in your account.

8. Refunds

We offer a 30-day money-back guarantee. Please see our Refund Policy for details on how to request a refund.

9. Service availability

We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free access. We may need to perform maintenance, updates or changes to the Service from time to time. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay, or pose a security or fraud risk. You may stop using the Service at any time. On termination, your right to use the Service ends; your published designs may be removed and your data may be deleted in accordance with our Privacy Notice.

11. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with these Terms or the Service is limited to the amount you paid to us in the 12 months preceding the event giving rise to the claim. We exclude liability for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (such as fraud or personal injury caused by negligence).

12. Indemnity

You agree to indemnify us against any claims, losses or costs arising from Your Content, your unlawful use of the Service or your breach of these Terms.

13. Changes

We may update these Terms from time to time. If the changes are material we will notify you. Continued use of the Service after the changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Eventovias is established. Any disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer law gives you the right to bring proceedings elsewhere.
